WEB HOSTING & EMAIL HOSTING TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions (“Agreement”) govern the provision of web hosting and email hosting services by Webnetave.com (operating as Canada Web Pro) (“Provider”, “we”, “us”, “our”) to you (“Customer”, “you”, “your”). By purchasing or using any hosting service, you agree to be bound by this Agreement.

This Agreement applies to the following websites: canadawebpro.ca, canadawebpro.com, webnetave.com, hostnetave.com

1. General Service Terms

1.1 Shared Hosting Environment All shared hosting plans operate in a shared resource environment. To maintain stability and performance for all customers, we may apply resource limits or take corrective action if your usage negatively impacts server performance.

1.2 Right to Modify or Restrict Services We may, at our discretion, limit, suspend, or adjust service resources to protect system integrity, prevent abuse, or comply with legal obligations.

1.3 No Guarantee of Unlimited Resources “Unlimited” features (where applicable) are subject to fair‑use policies and technical limitations.

2. Acceptable Use Policy (AUP)

You agree not to use hosting services for any unlawful, harmful, abusive, or disruptive activities. Prohibited uses include, but are not limited to:

2.1 Prohibited Content & Activities

  • Hosting or distributing illegal, harmful, or abusive content
  • Hacking tools, malware, phishing, or security‑breaching software
  • Pirated software, warez, or copyright‑infringing material
  • High‑risk financial schemes (HYIP, Ponzi, pyramid schemes)
  • Hate, harassment, or extremist content
  • Proxy scripts, anonymizers, or mass‑file‑sharing systems
  • Cryptocurrency mining or related server‑intensive activities
  • Running IRC bots, P2P clients, or torrent services
  • Running long‑running or unattended server‑side processes
  • Excessive resource usage that impacts server stability

2.2 Email Usage Restrictions

  • No sending of unsolicited email (spam)
  • No automated email sending from scripts without proper configuration
  • No sending from invalid or misconfigured email addresses
  • No sending to large numbers of invalid recipients
  • No sending of malicious or infected email content

Violations may result in temporary suspension or permanent termination.

3. Resource Usage Limits

3.1 CPU, Memory & Disk Usage

To maintain server performance, the following limits apply:

  • No single account may use more than 25% of system resources for more than 90 seconds
  • No more than 100,000 files on shared hosting
  • No MySQL query may run longer than 15 seconds
  • No more than 50% of your hosting disk space may be used for email storage
  • Email storage may not exceed 10 GB per hosting account

3.2 Bandwidth Usage

Bandwidth is unmetered under fair‑use guidelines. Excessive usage that impacts server performance may require an upgrade to VPS or dedicated hosting.

4. WordPress Hosting Terms

For Managed WordPress Hosting:

  • Hosting is optimized exclusively for WordPress
  • Some plugins may be incompatible with the hosting environment
  • DNS must use Webnetave.com name servers
  • We may deny configuration changes that compromise performance
  • Installing WordPress implies acceptance of Automattic’s Terms & Privacy Policy

5. HIPAA & Sensitive Data Disclaimer

Our hosting services are not compliant with HIPAA or similar medical‑data regulations. You may not store or process:

  • medical records
  • protected health information (PHI)
  • sensitive personal data requiring regulated storage

Storing such data is a material breach and grounds for immediate termination.

6. Backups & Data Responsibility

6.1 Customer Responsibility

You are fully responsible for maintaining your own backups of:

  • website files
  • databases
  • emails
  • documents

6.2 Provider Backups

We may perform periodic backups for disaster‑recovery purposes, but:

  • backups are not guaranteed
  • backup restoration is best‑effort only
  • fees may apply for restoration
  • backups may not include email data
  • backups should not be relied upon as your primary backup solution

We strongly recommend using CodeGuard or another offsite backup service.

7. Service Availability & Risk

Your use of hosting services is at your own risk. We are not responsible for:

  • data loss
  • service interruptions
  • security breaches caused by customer actions
  • downtime caused by third‑party software or plugins

We take reasonable measures to maintain uptime and security but cannot guarantee uninterrupted service.

8. Suspension & Termination

We may suspend or terminate hosting services if:

  • you violate this Agreement or the Acceptable Use Policy
  • your usage threatens server stability
  • you engage in illegal or harmful activities
  • you fail to pay for services

Suspension or termination does not relieve you of outstanding payment obligations.

9. Liability Limitation

To the fullest extent permitted by law:

  • Webnetave.com / Canada Web Pro is not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount paid for hosting services in the previous 12 months
  • We are not responsible for customer‑installed software, scripts, or third‑party integrations

10. Changes to This Agreement

We may update these Terms at any time. Changes take effect immediately upon posting. Continued use of hosting services constitutes acceptance of updated terms.
