3. E‑COMMERCE & DIGITAL PRODUCTS

This section applies to all future digital products, templates, tools, downloads, or subscriptions sold on canadawebpro.ca.

3.1 Product Availability Products may be added, removed, or modified at any time.

3.2 Pricing Prices may change without notice. Taxes may apply.

3.3 Digital Product Delivery Digital products are delivered electronically via download or email.

3.4 Refunds for Digital Products All digital product sales are final unless otherwise stated.

3.5 Licensing Unless otherwise stated, digital products are licensed for single‑site personal or business use. You may not:

3.6 Subscriptions (If Offered) Subscriptions renew automatically unless cancelled. You may cancel at any time before the next billing cycle.

4. WEBSITE DESIGN & DEVELOPMENT SERVICES

Website design services are governed by our Website Design Terms of Service (WD‑TOS), which are incorporated into these Terms.

Key points include:

  • Deposits are non‑refundable
  • Final payment is required before launch
  • Revisions are limited
  • Additional work is billed separately
  • Client must provide content and approvals
  • No guarantee of SEO ranking
  • No guarantee of legal compliance (CASL, PIPEDA, accessibility, etc.)

5. WEB HOSTING & EMAIL HOSTING SERVICES

Hosting services are governed by our:

  • Web Hosting Terms & Conditions (WHTOS)
  • Acceptable Use Policy (AUP)
  • Billing Policy

These policies are incorporated into these Terms.

Key points include:

  • No adult content
  • No spam (CASL compliance required)
  • No illegal activity
  • No excessive resource usage
  • No personal backup storage
  • No guarantee of uptime
  • No guarantee of data retention
  • Backups are the client’s responsibility

6. ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

We do not guarantee that information on our websites is accurate, complete, or current. Content may be updated or removed at any time.

7. THIRD‑PARTY TOOLS & SERVICES

We may use or integrate third‑party tools, plugins, APIs, or services. We are not responsible for:

  • outages
  • bugs
  • security issues
  • changes in functionality
  • data loss
  • third‑party failures

Your use of third‑party tools is at your own risk.

8. SECURITY & DATA RESPONSIBILITY

8.1 No Guarantee of Security We do not guarantee that our services are free from:

8.2 Client Responsibility Clients are responsible for:

  • strong passwords
  • keeping software updated
  • maintaining backups
  • monitoring their own accounts

  • harmful or abusive behaviour
  • distributing malware
  • phishing or fraud
  • hosting child exploitation content
  • spam or CASL violations
  • copyright infringement
  • excessive resource usage
  • circumventing security
  • hosting anonymous proxy services

10. BILLING & PAYMENTS

Billing is governed by our Billing Policy, which is incorporated into these Terms.

Key points include:

  • All fees are in CAD
  • Interac e‑Transfer is the primary payment method
  • No credit card information is collected
  • Hosting fees are non‑refundable
  • Domain fees are non‑refundable
  • Late payments may result in suspension or termination

11. PORTFOLIO RIGHTS

Unless requested otherwise in writing, WEBNETAVE.COM may:

  • display completed websites in our portfolio
  • use screenshots for marketing
  • list the client as a customer

12. NO LEGAL ADVICE

We do not provide legal advice. Clients are responsible for ensuring their website complies with:

  • PIPEDA
  • CASL
  • Accessibility laws
  • Industry‑specific regulations
  • Privacy requirements

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for data loss, revenue loss, or business interruption
  • Our total liability is limited to the amount paid for the service or product

14. INDEMNIFICATION

You agree to indemnify and hold WEBNETAVE.COM harmless from any claims arising from:

  • your content
  • your use of our services
  • your violation of these Terms
  • your violation of applicable laws

15. TERMINATION

We may suspend or terminate your access to services for:

  • non‑payment
  • abuse
  • illegal activity
  • AUP violations
  • security risks
  • failure to respond to compliance notices
